Terms of Service
The contract between you and Seedream Studio when you use the service.
Last updated
1. Acceptance
By creating an account, signing in, or otherwise using Seedream Studio (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
2. Your account
You must be at least 16 years old to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for any activity under your account.
We provision your account when you sign in via a supported OAuth provider. Each account starts with a default workspace; you may create additional workspaces and assign them to projects, clients, or experiments.
3. Fees and billing
- Free-plan accounts may use the Service within the published quota at no charge.
- Paid plans are billed in advance, monthly or annually, in the currency shown at checkout.
- Per-account spend caps are enforced before each generation; you cannot incur usage charges above the cap you set.
- Refunds are issued at our discretion. Annual prepayments are non-refundable past the first 14 days.
- We may change prices with 30 days' notice; price changes do not apply to billing periods already paid for.
4. Your content and ownership
You retain all rights, title, and interest in and to the prompts, reference images, generated outputs, labels, and workspace metadata that you submit to or create through the Service (collectively, "Your Content"). We claim no ownership of Your Content.
Subject to applicable provider terms and the law of your jurisdiction, you may use generated outputs for personal or commercial purposes. You are solely responsible for the legality and ethics of how you use Your Content.
5. Our license to operate the service
To operate the Service, you grant us a worldwide, non-exclusive, royalty-free license to host, store, copy, transmit, display, and process Your Content solely as needed to provide the Service to you. This license terminates when you delete Your Content or close your account, except to the extent we must retain limited copies for backup, audit, or legal-compliance reasons.
We do not use Your Content to train models, ours or any third party's.
6. Third-party providers
The Service uses third-party providers — including but not limited to ByteDance / BytePlus for inference — to deliver generation features. Submitting prompts and reference images to the Service results in a request to the underlying provider's API. Provider availability, latency, and model behavior are outside our control.
7. Acceptable use
Your use of the Service is also governed by our Acceptable Use Policy. Violations may result in immediate suspension or termination of your account, with or without notice.
8. Termination
You may close your account at any time from the account settings page. We may suspend or terminate your account if you breach these Terms or the AUP, or if required by law.
On account closure your data is retained for 30 days in a recoverable state, after which it is permanently deleted from live systems. Backup expiry follows the schedule in our Security documentation.
9. Disclaimers
The Service is provided "AS IS" without warranty of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
10. Limitation of liability
To the maximum extent permitted by law, our total aggregate liability arising out of or related to the Service is limited to the greater of (a) the fees you paid to us in the 12 months preceding the claim or (b) USD 100. We are not liable for indirect, incidental, consequential, or punitive damages.
11. Governing law
These Terms are governed by the laws of the jurisdiction in which the operating entity is incorporated, without regard to conflict-of-law principles. Disputes are resolved in the courts of that jurisdiction.
12. Changes to these terms
We may revise these Terms from time to time. Material changes will be notified by email and posted to this page at least 14 days before they take effect. Continued use after the effective date constitutes acceptance of the revised Terms.
